1. Who we are

This policy explains how the Viva group of companies collects and uses personal information about our customers, visitors, enquirers and website users.

The companies covered by this policy are:

  • Viva (Blackpool) Group Ltd (company number 11886759), which operates our box office, ticketing and customer communications;
  • Viva Blackpool Limited (company number 11886853), which operates the venue at 3 Church Street, Blackpool;
  • Viva Entertainments Limited (company number 12406972), which operates our touring shows and some merchandise sales

Each company is a data controller for the personal information it handles. Viva (Blackpool) Group Ltd is the point of contact for any question or request about your information, whichever company holds it.

2. What this policy covers

This policy covers information we collect when you book tickets, visit the venue, attend an event, contact us, sign up for marketing, enter a competition, apply for a job or use our websites. Our websites include vivablackpool.com and vivaentertainments.co.uk.

3. Information we collect

Information you give us:

  • Name, email address, postal address, postcode and telephone number.
  • Booking details: the events you book, seats, dates, party size, group bookings and your booking reference.
  • Pre-orders and requests relating to your visit, including food and drink orders, celebration packages and dietary requirements.
  • Accessibility requirements, where you tell us about them so we can make arrangements for your visit.
  • Payment information. Card details are handled by our payment providers and are not stored by us.
  • Correspondence, enquiries, feedback, survey responses and reviews.
  • Information you provide if you apply for a job or work with us as a content creator.

Information we collect automatically:

  • Device and browser type, IP address, and the pages you view on our websites.
  • How you move through the booking process, including events viewed and items added to your basket.
  • Whether you open our emails and which links you click.
  • CCTV footage when you visit the venue.
  • Photographs and video taken at the venue, where you appear in them — see section 15.

Information we receive from others:

  • Booking details passed to us by ticket agents and travel partners, including GetYourGuide and Viator, where you book through them.
  • Information from group organisers, coach operators and event organisers who book on your behalf.
  • Aggregated, non-identifying reporting from advertising and analytics platforms.

4. How we use your information, and our lawful basis

Under data protection law we must have a lawful basis for using your information. Ours are set out below.

5. Marketing

We send marketing by email and SMS about our shows, events and offers.

If you have booked with us or asked about booking, we may send you marketing about similar shows and events on the basis of our legitimate interests, unless you tell us not to. You are given the opportunity to refuse this when we collect your details and in every message we send. If you have not booked with us, we will only send you marketing if you have asked us to.

You can stop marketing at any time using the unsubscribe link in any email, by replying STOP to any text message, or by contacting us on 01253 297 297 or at [email protected]. Opting out of marketing does not stop service messages about a booking you already hold.

We do not sell your information, and we do not share it with other companies for them to market their own products to you.

Survey and feedback invitations are separate from marketing and are covered in section 19. Opting out of one does not opt you out of the other, and you can stop either at any time.

6. Cookies and similar technologies

Our websites use cookies and similar technologies, including tracking pixels and tags, to make the site work, to understand how it is used, and to deliver and measure advertising. Some of these run on our own servers rather than in your browser, but the same choices apply to them.

We use four categories:

  • Strictly necessary — needed for the site and the booking process to work. These cannot be switched off.
  • Analytics — how people find and use the site, so we can improve it.
  • Advertising — delivering our advertising on other platforms and measuring which advertising leads to bookings.
  • Functional — remembering preferences, such as your cookie choices.

Apart from the strictly necessary ones, we use these only where you have given consent through the cookie banner on our site.

7. Advertising and audience matching

We advertise on Google, Meta (Facebook and Instagram), TikTok and Microsoft. To make our advertising relevant and to measure whether it works, we may share a secure, scrambled version of your email address or telephone number with these platforms so they can tell whether you are already one of our customers. The scrambled version cannot be read as a plain email address or telephone number.

We use this to show our advertising to existing customers, to avoid showing certain advertising to people who have already booked, and to help the platforms find new audiences similar to our customers.

We do this only where you have consented to advertising cookies and similar technologies. You can stop it at any time by withdrawing that consent through [our cookie settings], or by contacting us.

8. Who we share your information with

We share information with the following categories of recipient. All of them are required to use it only for the purposes we specify.

If our business or any part of it is sold or reorganised, customer information may be transferred as part of that transaction.

9. Where your information is held

Most of our suppliers hold information in the UK or the European Economic Area. Some, including our advertising and analytics providers, are based in the United States or hold information there. Where information is transferred outside the UK we rely on UK adequacy regulations, or the International Data Transfer Agreement or UK Addendum where no adequacy decision applies, so that it remains protected to the standard UK law requires.

11. Keeping your information secure

We take appropriate technical and organisational measures to protect your information against loss, misuse and unauthorised access. Our systems are accessed through individual accounts, with access limited to staff who need it, and our main suppliers hold recognised security certifications. Card payment details are handled entirely by our payment providers and are not stored on our systems.

No transmission over the internet can be guaranteed completely secure. Where you hold an account with us, please keep your password confidential.

12. Your rights

You have the right to:

  • ask for a copy of the information we hold about you;
  • have inaccurate information corrected;
  • ask us to delete your information, in certain circumstances;
  • ask us to restrict how we use your information, in certain circumstances;
  • object to our using your information where we rely on legitimate interests, and to object to direct marketing at any time;
  • receive certain information in a portable format;
  • withdraw your consent at any time, where we rely on consent.

If your request is complex we may extend that by up to two further months, and will tell you if we do. There is normally no charge.

13. How to complain

If you are unhappy with how we have handled your information, please tell us first at [email protected] or by writing to the address above, so that we can put it right. We will acknowledge your complaint within 30 days and respond as quickly as we can.

You also have the right to complain to the Information Commissioner’s Office at any time, at ico.org.uk/make-a-complaint, by calling 0303 123 1113, or by writing to the Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF.

14. Children

We welcome children at many of our shows, but our websites and booking process are intended for adults. Bookings should be made by someone aged 18 or over, and we do not knowingly collect information directly from children. Where we hold information about a child as part of a family booking, we use it only to prepare for that visit. We do not send marketing to children. If you believe we hold information about a child that we should not, please contact us and we will remove it.

15. Filming and photography at the venue

We take photographs and film at our venue. We use this material to promote Viva and the shows we programme — on our websites and social media channels, in paid advertising, in print and press material, and in our archive.

Audience and atmosphere filming

When you visit, you may appear in photographs or video we take of the audience, the venue or the show. We do this on the basis of our legitimate interests in promoting our business, and because live entertainment audiences would ordinarily expect a venue to capture the atmosphere of an event. We tell you when you book, and signs are displayed at the entrance and in the areas where we film.

If you would rather not appear, you can tell us and we will make sure you are not included. Speak to our box office before your visit, or tell a member of the team when you arrive, and we will [give you a wristband our photographers can recognise, and seat you outside the area we are filming]. You can also object afterwards and ask us to stop using an image of you. Contact us at [email protected] and we will remove it.

Photographs and video in which you are the subject

If we would like to use material in which you are the focus rather than part of a crowd — a close-up, an interview, a review or a photograph used on its own to advertise a show — we will ask you at the time and explain what we want to use it for. You are free to say no, and saying no will not affect your visit. If you say yes, you can change your mind later by contacting us.

Children

We will not use a photograph or video in which a child can be identified to promote Viva unless a parent or guardian has agreed to it. Where we photograph or film at a family show, we ask parents and guardians at the time and record their answer. If you would prefer your child not to appear at all, tell a member of the team when you arrive and we will make arrangements. If you believe we have used an image of your child without your agreement, contact us and we will remove it.

How long we keep it

We keep promotional photography and video for 6 years, and archive material for longer where it forms part of our record of the venue’s history. If you ask us to stop using an image we will do so, although we cannot recall material that has already been printed or shared publicly by others.

CCTV is separate from this and is covered in section 17.

16. Photographs taken with our cast

When you arrive we may invite you to have your photograph taken with a member of our cast. The photograph is then made available for you to buy, during or after your visit.

Having the photograph taken is up to you

If you would rather not, just tell the photographer. Nothing about your visit changes and you will not be asked again.

Where your photograph goes

We upload photographs to SmugMug, the photography platform we use so that you can view and buy your pictures yourself. Your photographs are placed in a gallery that is not publicly listed and cannot be found through a search engine. It can only be reached using the link  we give you at the venue and in the post visit email. SmugMug stores the images on our behalf, and handles the payment if you decide to buy.

Why we are allowed to do this

We take and hold the photograph because you have asked us to and because we are taking steps to supply it to you. We do not use photographs taken at the photo point to advertise Viva unless we ask you separately and you agree.

Children

We photograph a child only where a parent or guardian is present and happy for us to do so. Those photographs go into the same private gallery, reachable only with the code we hand over at the time, and we never use a photograph taken at the photo point of a child for any promotional purpose.

How long we keep it

Your photographs stay available for 180 days after your visit and are then deleted. If you buy a photograph we keep a record of the purchase in line with section 11.

Removing a photograph

You can ask us to remove a photograph at any time, whether or not you have bought it. Contact us at [email protected] or speak to a member of the team, and we will take it down.

17. CCTV at the venue

CCTV operates throughout the venue for the safety and security of visitors and staff and for the prevention and detection of crime. Signs are displayed in the areas covered. CCTV is not used for promotion or marketing. Footage is retained for 60 days and is shared only with the police, our insurers or our legal advisers where there is a proper reason to do so.

18. Filming and photography by guests

Our conditions of entry restrict filming and photography by guests, including the use of wearable devices capable of recording, such as smart glasses. This is to protect the privacy of other guests, our performers and our staff. The full terms are set out in our Conditions of Entry.

If another guest has recorded or shared an image of you and you are concerned about it, please tell a member of our team or contact us at [email protected]. We will do what we reasonably can to help, although material published by another person is not within our control and you may also wish to approach the platform it appears on.

19. Surveys, feedback and research

We ask guests for feedback after a visit, and from time to time we invite guests to take part in follow-up surveys, so that we can understand what we are doing well and what we should improve.

Your answers are linked to your booking

We link your survey responses to your booking record — the show you saw, the date and night of the week, how you booked, your party size and what you spent with us. We do this so that we can tell which shows, nights and types of visit a piece of feedback relates to, and plan our programme, pricing and service around it.

This means your responses are not anonymous to us, even though we normally report results internally as totals rather than individually. If you would prefer to give feedback without it being linked to you, ask a member of the team for a paper form.

Our lawful basis

We rely on our legitimate interests in understanding our customers and improving our business. You can object at any time, and you can ask us to stop sending survey invitations using the unsubscribe link in any of them. If you would rather not take part, simply ignore the invitation — it will not affect your booking or how we treat you.

Prize draws and incentives

Where we offer an incentive for taking part, such as entry into a prize draw, the terms will be published with the survey. We use your contact details to run the draw and to let you know if you have won. Taking part in a survey or a prize draw does not sign you up for marketing, and we will never make entry conditional on your agreeing to receive marketing from us.

Please leave out sensitive details

Our surveys are not the right place for information about your health. Please do not include it in free-text answers. If you do tell us something of that kind — for example about an accessibility need or a dietary requirement — we will use it only to respond to the point you have raised and to improve our facilities, and we will remove it before your response is used for analysis.

Children

Our surveys are intended for guests aged 18 and over, and we do not send them to children.

What we do not do with your answers

We do not use your survey responses to target advertising to you, and we do not share individual responses with the promoters of the shows you have seen. Where a promoter receives feedback about their show, it is aggregated and does not identify you.

How long we keep them

We keep survey responses linked to your booking for 12 months. After that we anonymise them and keep only aggregated statistics, which can no longer be connected to you.

20. Job applicants and content creators

If you apply for a job with us, we use the information in your application to assess your suitability and, if you are successful, to prepare your employment record. We keep unsuccessful applications for 12 months in case another role arises.

If you work with us as a content creator or influencer, we use your contact details and social media handles to arrange and manage that collaboration.

21. Links to other websites

Our websites contain links to other sites, including ticket agents, partners and social media. We are not responsible for how those sites handle your information, and we suggest you read their own privacy policies.

22. Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last changed. Where a change is significant we will tell customers directly.
